Introduction

Thank you for using Human Japanese! We work hard to provide high-quality content and an enjoyable environment in which to study Japanese. By using humanjapanese.com or any of its subdomains (herein, “Human Japanese”) you agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, please discontinue use of Human Japanese.

Intellectual property rights

Our team works hard to produce content for Human Japanese. Occasionally, we also work with third-parties to create or adapt content for Human Japanese. In this document, “Human Japanese Content” shall mean any educational material appearing in Human Japanese, including (for the sake of illustration and without implying any limitation) Japanese text comprising lessons, dialogs, example sentences, and so on; English and Japanese annotations attached to such text; audio recordings of such text; and discussion comments.

You are granted a license to utilize the Human Japanese Content that is included as a part of your subscription plan for your own personal educational purposes, which may include listening to the audio, reading the text, reading discussion comments, and participating in discussions, for as long as you maintain a subscription in good standing.

Human Japanese contains a discussion section that allows users to ask questions and receive answers from Human Japanese staff. We spend a significant amount of time each week replying to questions made via the discussion system, and such question-and-answer exchanges are visible and valuable to other users as well. By posting to our discussion system, you grant Brak Software, Inc. a non-exclusive, royalty-free, worldwide license to display your posts in perpetuity, even if you subsequently close your Human Japanese account. In plain English, you agree to allow us to display your posts on our discussion system at no cost to us for as long as we run Human Japanese. The motivation is to preserve question-and-answer exchanges on our discussion system for the benefit of future readers. If privacy is a concern, we can change your discussion display name to a pseudonym at your request. (You can also do this yourself within Preferences at any time.) If you do not accept these terms, please simply avoid posting on our discussion system.

Conduct

Please be respectful and courteous in your interactions with others on Human Japanese. At our sole discretion, we may suspend your access to the discussion feature of Human Japanese if we determine that, in our judgment, your interactions are not respectful and courteous.

Satori Reader

Depending on your subscription, your plan may include access to use certain features of our partner site, Satori Reader. By using Satori Reader, you agree to its terms and privacy policy (which are essentially the same as these ones, but apply to Satori Reader content).

Restrictions

You may not:

• Publish Human Japanese Content in any other media, except with express written permission from Brak Software, Inc;
• Sell, sub-license, or otherwise commercialize Human Japanese Content;
• Use Human Japanese in any way that is or may be damaging to Human Japanese;
• Use Human Japanese in any way that impacts user access to Human Japanese;
• Engage in any data mining, data harvesting, data extracting, or any other similar activity in relation to Human Japanese;

Certain areas of Human Japanese, and certain Human Japanese Content, may be restricted from being accessed by you, and we may further restrict access by you, at any time, at our absolute discretion. Any user ID and password you may have for Human Japanese shall be treated as confidential.

No warranties

We work hard to produce high-quality, accurate resources. However, we’re human and sometimes we make mistakes. Human Japanese is provided “as is,” and Brak Software, Inc. makes no representations or warranties of any kind related to Human Japanese.

Limitation of liability

In no event shall Brak Software, Inc., nor any of its officers, directors and/or employees, be held liable for anything arising out of or in any way connected with your use of Human Japanese.

Indemnification

You hereby indemnify Brak Software, Inc. and its officers, directors, and employees, from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

Variation of terms

Brak Software, Inc. is permitted to revise these Terms at any time as it sees fit, and by using Human Japanese, you agree to review these Terms on a regular basis.

Assignment

Brak Software, Inc. may assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Entire agreement

These Terms constitute the entire agreement between Brak Software, Inc. and you in relation to your use of Human Japanese and supersede all prior agreements and understandings.

Governing law and jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the State of Washington, USA, and you submit to the non-exclusive jurisdiction of the state and federal courts located in King County, Washington, USA, for the resolution of any disputes.
